ROWDY’s Return and Exchanges Policy
STANDARD RETURN AND EXCHANGES POLICY
- We at Rowdy want you to be happy with your purchase. We warrant to you, as the customer, that the Goods you receive are of good quality, in good working order, free of any defects and that they will be usable and durable for a reasonable period of time.
- Should you not be completely happy with your Goods, you are entitled to return them to us in order to have them replaced or repaired, or to a refund of your purchase amount or a credit to your account in the equivalent sum (“Returns Policy”), and subject to the below terms.
- It is imperative that you read and adequately familiarise yourself with the contents of this policy.
- This Policy applies generally to products either bought directly from Rowdy or from any of our pre approved Third Party sellers, subject to certain exceptions. It is your duty to read and adequately familiarise yourself with the terms herein. We reiterate that our Returns policy is meant to be read together with the provisions of the CONSUMER PROTECTION ACT 68 of 2008 and/or ELECTRONIC COMMUNICATIONS AND TRANSACTIONS ACT 25 OF 2002.
- This Policy forms part of the Rowdy Terms and Conditions, and so words defined in the Terms and Conditions have the same meaning in this Policy, unless the context indicates otherwise. Nothing in this Policy is intended to limit your statutory rights in any way.
RETURNING GOODS UPON DELIVERY
- It is important that upon delivery of your Goods from Rowdy, you inspect them and ensure that:
- the Goods delivered to you correspond to the Goods you viewed and purchased on our website
- they are of good quality and are reasonably suited for the purpose for which they are intended; and
- if the Goods were made in terms of a specific (custom) order, confirm that they correspond to the specifications of that Order.
- If you find that this is not the case, you must refuse delivery of the Goods and inform Rowdy immediately via our Returns Portal to have the goods replaced, repaired or to cancel the purchase, without any penalty on your part, and receive a full refund of the complete purchase price within 10 days.
- Once you have refused delivery, the courier will return the Goods to our Factory, at absolutely no cost to you.
- You will still be entitled to make an election in respect of your Goods as set out above if:
- when delivery was made, you did not have a reasonable opportunity to inspect the goods and when you did so, you decided to reject them on the grounds set out above;
- you received Goods that you ordered mixed with other Goods that you did not and wish to reject delivery of all of the Goods; and
- the goods you received were for a specific purpose that you expressly communicated to Rowdy and within 10 (TEN) business days it is found that the Goods do not meet this purpose.
- This section is not applicable to you if you purchased your goods from one of our pre-approved third party sellers and not directly from us. Should you wish to return goods upon delivery, then kindly refer to the third party seller’s terms and conditions. Rowdy will absolutely not be responsible for any goods returned upon delivery in such instances.
COOLING OFF PERIOD
- If you purchased Goods from Rowdy and you decide against keeping them for no specific reason, you can return the Goods to Rowdy, by logging onto the Returns portal, within 7 (SEVEN) days.
- If you are located in South Africa, we will arrange for the Goods to be returned to us at no cost to you (“free shipping”).
- For our international customers (outside South Africa) you must arrange for a courier to return the Goods to Rowdy and at your own cost. After we make sure that the Goods are undamaged, we will give you a refund of your purchase price within 10 business (TEN) days from the date when you notified us that you wanted to return the goods.
- Should you have had your goods specially manufactured according to your individual specifications (“custom made”), then you will not be able to return the goods in terms of our cooling off period.
RETURN OF DEFECTIVE GOODS
- We at Rowdy pride ourselves on the quality of and the workmanship that goes into all our products. We promise you that the Goods you receive from us will:
- be reasonably suitable for the purpose that they are intended to be used for;
- be of good quality, free of defects and in good working order; and
- will be durable and usable for a reasonable period of time.
- DEFECTS are a material imperfection in the manufacture of a Good, or any characteristic of a Good, which makes the Good less acceptable than one would reasonably be entitled to expect in the circumstances.
- Defects are manufacturing imperfections that may be present in the goods and detract from their aesthetics, and intended usage such as poor stitching, faulty or loose zippers, buckles, straps, lining etc
- Defects are NOT:
- faults resulting from normal wear and tear;
- damage arising from negligence, user abuse or incorrect usage of the product;
- damage arising from electrical surges or sea air corrosion;
- damage arising from a failure to adequately care for the product;
- damage arising from unauthorised alterations to the product; and
- where the specifications of a product, although accurately described on the Website and generally fit for its intended purpose, do not suit you.
- If you purchase goods from Rowdy or from our pre approved third party sellers and they turn out to be defective or otherwise of poor quality you can elect to:
- return the goods to us and claim a refund of your full purchase price;
- replace the goods; and/or
- have the goods repaired, if possible.
- You can make this election in respect of goods at any time within 6 (SIX) months of you purchasing the Goods.
- In order to exercise this option, you need to:
- In the case of consumers who purchased directly from Rowdy,please kindly contact us using the Returns Portal as set out below and we will arrange to collect the Goods from you completely free of charge, or
- In the case of consumers who purchased from our Third Party Sellers, kindly contact them or refer to their individual policies in order to arrange for the return of defective goods.
- Once Rowdy receives your Goods, inspects and confirms that they are defective, we will act to repair or replace the product (if such repair is possible / we have the same product in stock to use as a replacement) or refund your full purchase price. Please note that for clients of third party sellers, the third party sellers will be responsible for refund of your purchase price.
- Once this 6 month period expires, we will only be able to deal with any defective Goods in terms of the ‘LIMITED LIFETIME GUARANTEE’ the terms of which are incorporated herein.
RETURN OF GOODS DAMAGED DURING SHIPPING
- We at Rowdy take full responsibility for ensuring that your Goods are shipped securely and delivered undamaged when returning an exchanged product to you.
- Should the Goods be damaged during delivery, please ensure that you notify us immediately upon receipt and inspection of the goods and via our Returns portal, whereafter we will arrange for the Goods to be collected from you at no cost.
- We will ensure that the Goods are either replaced or repaired, if possible, and delivered to you at no charge. Should you wish to return the damaged Goods and obtain a refund, we will refund your purchase price within 10 (TEN) days of you electing to do so.
- These terms are specific to consumers who purchased goods directly from Rowdy. Should you have purchased goods directly from third party sellers, we will not be responsible for any damages that may occur to the goods while they are being shipped to you. You must deal directly with the third party seller.
LOGGING A RETURN
- This section applies only to consumers who purchased goods directly from Rowdy.
- When logging Goods for return, replacement or repair, we ask that you do so via our online portal here. Should you require assistance with the returns process please contact us via email.
- Once you have logged your return, we will then proceed with the Returns process.
- It is important that when you log your return, you have the details of your purchase on hand and indicate in writing whether you would like the item repaired, replaced or your purchase price refunded.
PREPARING ROWDY GOODS FOR RETURN
- We need your help in order to ensure that any returns of Goods are processed as quickly and efficiently as possible. Accordingly Rowdy requests that when returning you;
- package your products safely and securely for protection during transit;
- clearly mark your return reference number on the outside of the parcel; and
- include any and all accessories and parts, if applicable, that were sold with the product.
- Should you fail to do so, there may be delays encountered in the processing of your request or we may exercise our rights to decline the return entirely.
COLLECTION
- Where Rowdy is liable for arranging collection of the Goods from you, we will collect the Goods from you at a time that will be determined with you beforehand. We emphasise that your liability for any costs associated with returning the Goods to us will be determined based on the reasons for such return as set out above.
CHARGES AND REFUNDS
- If you return a defective Goods to us, but you fail to return any and/or all of the accessories and parts that were sold with those Goods, we are entitled to (subject to applicable law) refuse the return, or only replace those Goods that you did return; or to estimate the value of the missing accessories and parts and to credit or refund you in respect of the returned Goods only.
- If you return Goods that do not comply with this Policy, you may be liable to reimburse Rowdy for the cost of collecting the product from you and the cost of having the Goods returned to you.
- Please note that for all our South African based clients, refunds will be effected via EFT to a nominated bank account, while for our international customers we will make payment either via PayPal or international bank transfer to a nominated bank account.
